These Terms & Conditions govern the use of www.becontra.com, purchases made through our online store, and, where applicable, purchases made in our physical retail store.

This website is operated by Followorld, LDA, trading under the brand BE CONTRA.

By accessing this website, creating an account or purchasing our products, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms, please discontinue the use of this website.

2. Scope

These Terms apply to:

the use of this website;
all purchases made through www.becontra.com;
purchases made in our physical retail store where applicable;
all services provided by Followorld, LDA under the BE CONTRA brand.

3. Eligibility

By placing an order, you confirm that you are legally capable of entering into binding contracts under the laws applicable to you.

Where required by applicable law, purchases made by minors must be authorised by a parent or legal guardian.

4. Products

We strive to ensure that all product descriptions, specifications and photographs accurately represent our products.

However:

colours may vary depending on screen settings;
slight variations between photographs and the actual product may occur;
measurements are approximate unless otherwise stated.

Product availability is subject to stock.

5. Pricing

All prices displayed on our website are expressed in Euro (€).

Unless otherwise stated, all prices include Portuguese Value Added Tax (VAT) at the applicable rate.

Shipping costs are calculated separately during checkout.

Although every effort is made to ensure pricing accuracy, errors may occasionally occur. If a product is listed at an incorrect price due to a typographical error, technical issue or system malfunction, Followorld, LDA reserves the right to cancel the affected order and refund any amounts already paid.

6. Orders and Contract Formation

Placing an order does not automatically constitute acceptance of that order. An order becomes binding only after it has been accepted and confirmed by Followorld, LDA. Order confirmation is sent by email to the address provided at checkout, and the contract is concluded in English.

We reserve the right to refuse or cancel any order in circumstances including, but not limited to:

product unavailability;
suspected fraudulent activity;
pricing or technical errors;
payment authorisation failure;
violations of these Terms & Conditions.

If payment has already been processed, a full refund will be issued using the original payment method.

7. Stock Availability

All orders are subject to product availability.

If an item becomes unavailable after an order has been placed, we will inform the customer as soon as reasonably possible and offer either:

a full refund; or
an alternative product, where appropriate.

The customer will always have the right to decline the alternative offered.

8. Payment

We currently accept the following payment methods:

Payments are processed through secure payment service providers. BE CONTRA does not store complete payment card information.

9. Shipping

Shipping conditions, delivery estimates, costs and international shipping information are described in our Shipping Policy, which forms an integral part of these Terms & Conditions.

10. Right of Withdrawal (Online Purchases)

Consumers residing within the European Union benefit from the statutory right of withdrawal provided by applicable consumer protection legislation for distance purchases.

Unless an exception applies, customers who purchase through www.becontra.com have the right to withdraw from their purchase, without stating any reason, within 14 days of receiving the goods.

The right of withdrawal applies only to distance purchases made through our website. It does not apply to purchases made in our physical retail store, where any exchange or return is subject to our in-store exchange policy, without prejudice to the legal guarantee of conformity described in Section 11.

11. Legal Guarantee of Conformity

All products sold to consumers benefit from the legal guarantee of conformity provided by Decree-Law No. 84/2021, which in Portugal covers a period of three (3) years from the date of delivery of the goods.

If a product presents a lack of conformity within this period, the consumer is entitled, under the conditions set out by law, to:

repair or replacement of the product, free of charge;
a proportionate reduction of the price; or
termination of the contract with a full refund.

This legal guarantee applies to both online and in-store purchases and exists independently of, and in addition to, the right of withdrawal described in Section 10.

12. Retention of Title

Ownership of all products remains with Followorld, LDA until full payment has been received.

Risk of loss or damage transfers to the customer upon delivery.

13. User Accounts

Customers are responsible for maintaining the confidentiality of their account credentials.

Users agree to provide accurate information and to update their account whenever necessary.

Followorld, LDA reserves the right to suspend or terminate accounts used fraudulently or in breach of these Terms.

14. Acceptable Use

Users agree not to:

misuse this website;
interfere with its operation;
attempt unauthorised access to systems;
use automated systems to extract website content;
engage in unlawful activities through this website.

15. Intellectual Property

All intellectual property rights relating to this website, including its content, photographs, graphics, product designs, trademarks, logos, text and software, belong to Followorld, LDA or are used under appropriate licence.

The BE CONTRA name and visual identity are proprietary assets of Followorld, LDA.

The BECONTRA trademark is currently the subject of a European Union trade mark application before the European Union
Intellectual Property Office (EUIPO), under application No. 019351903.

No content from this website may be copied, reproduced or commercially exploited without prior written permission.

16. Website Availability

Although we strive to maintain uninterrupted access to the website, we do not guarantee continuous availability.

Temporary interruptions may occur due to maintenance, updates, technical issues or circumstances beyond our reasonable control.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Followorld, LDA shall not be liable for indirect, incidental or consequential damages arising from the use of this website or the purchase of products, except where liability cannot legally be excluded.

Nothing in these Terms limits any mandatory consumer rights provided by applicable law.

18. Force Majeure

Followorld, LDA shall not be held responsible for delays or failures in performing its obligations where such delays result from events beyond its reasonable control.

These events may include, but are not limited to: natural disasters, floods, fires, pandemics, strikes, transport disruptions, governmental actions, power outages, cyberattacks, wars or civil unrest.

In such cases, our obligations shall be suspended for the duration of the event.

19. Privacy

The processing of personal data is governed by our Privacy Policy and Cookie Policy, which form part of these Terms & Conditions.

20. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Portugal.

Nothing in these Terms affects the mandatory consumer protection rights granted by the laws applicable in the consumer's country of residence where such rights cannot legally be excluded.

In accordance with Portuguese Law No. 144/2015 of 8 September, consumers may resort to the following Alternative Dispute Resolution entity:
